This is an original proceeding in prohibition in which relator seeks to prevent respondent Judge from ordering that he be committed to jail for contempt because of his failure to comply with an order to pay alimony to his former wife. When the petition was first considered we concluded that the facts were not sufficiently disclosed. This court accordingly entered an order directing respondent to hold a hearing and take evidence on certain issues and report his findings of fact and Conclusions of law. Upon consideration of the findings so filed we issued our provisional rule on November 10, 1975. Because the case involves the constitutionality of Section 452.345 enacted in 1973, effective January 1, 1974, the attorney general has been permitted to intervene in order to defend the constitutionality thereof. We have concluded that the provisional rule should be discharged.
